Welcome to Edge 360 Fitness Limited (“we,” “us,” or “our”), trading as Edge 360 Fitness and The Parkinson’s Coach. These Terms and Conditions (“Terms”) govern your use of our personal training services, Parkinson’s fitness programs, online classes, run coaching services, website, mobile applications, and all related digital content (collectively, the “Services”).

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

1. About Us

Edge 360 Fitness Limited trades as Edge 360 Fitness and The Parkinson’s Coach and is registered in the United Kingdom under Company Number 10704709 (hereinafter referred to as “Edge 360 Fitness”). By accepting these Terms, you enter into a contractual agreement with Edge 360 Fitness Limited.

2. Eligibility and Participation

  • You must be 18 years or older to use our Services. If under 18, a parent or legal guardian must provide consent.

  • Our Services are designed to support your health and fitness goals but are not a substitute for medical diagnosis, treatment, or professional therapy.

  • You should consult your GP, neurologist, or healthcare professional before starting any new exercise or activity.

  • You are responsible for ensuring that exercises are appropriate for your personal health and ability level.

3. Health and Medical Disclaimer

  • Our services are not a substitute for professional medical advice, diagnosis, or treatment.  All content is for general information and educational purposes only.

  • Participation in any exercise program is entirely at your own risk.

  • You should stop exercising immediately and seek medical attention if you experience pain, dizziness, chest discomfort, shortness of breath, or other concerning symptoms.

  • By using our Services, you agree that Edge 360 Fitness, its instructors, staff, and affiliates shall not be held responsible or liable for any injury, health issue, or loss that may result from your participation.

  • While exercise can benefit individuals with medical conditions, we make no guarantees regarding symptom improvement, disease progression, or treatment outcomes. Individual results and experiences vary widely between individuals, and any improvements reported by other users are not guaranteed.

4. Accounts and User Responsibilities

  • You will be required to create an account to access certain Services. You agree to provide accurate and complete information and to keep your login details confidential.

  • You are responsible for all activity under your account.

  • You must not share your account, distribute our materials, or use our content for commercial purposes without our prior written consent.

  • We reserve the right to suspend or terminate your account if we believe you have breached these Terms or misused our Services.

5. Testimonials and Results Disclaimer

  • Any testimonials, case studies, or user feedback provided on our website, in promotional materials, or through our Services are individual experiences and do not guarantee that you will achieve the same results.

  • Results from our services will vary between individuals and depend on factors such as health status, commitment, and individual circumstances.

  • Testimonials are provided for informational purposes only and are not intended to replace professional medical advice or treatment.

  • You acknowledge and agree that Edge 360 Fitness is not responsible or liable for any outcomes you may experience, and participation in our services is at your own risk.

6. Intellectual Property

  • All videos, exercise routines, documents, logos, designs, trademarks and other materials provided through our Services are the intellectual property of Edge 360 Fitness.

  • You are granted a limited, non-exclusive, non-transferable licence to use our content for personal, non-commercial purposes only.

  • You must not copy, reproduce, modify, distribute or publicly display our materials without our prior written permission.

7. Payments, Subscriptions and Cancellations

  • Payments: Access to certain Services may require payment (one-off or recurring). Prices are stated in pounds sterling (£) and include VAT where applicable. All payments are processed securely through our third-party payment provider.

  • Subscriptions: Subscriptions renew automatically unless cancelled before the next billing date. You can manage your subscription or cancel at any time via your account or by contacting us at Katie@edge360fitness.co.uk OR info@theparkinsonscoach.co.uk.

  • Cancellation:  Cancellation takes effect immediately, and you will retain access to the programme and all associated materials until the end of your current billing cycle. The subscription will not renew thereafter.

  • Refunds: Because our programmes involve immediate access to digital content, you lose your 14-day cancellation right under the Consumer Contracts Regulations 2013 once streaming begins.  Refunds may, however, be granted at our discretion in cases of technical error or duplicate payment.

  • Price Changes: We may review and update our pricing from time to time. Any price change for existing subscribers will take effect at the start of the next billing period, and you will receive at least 30 days’ notice by email or through your account. If you do not agree to the new price, you may cancel your subscription before the change takes effect. Continued use of the Services after the effective date of the price change constitutes your agreement to the new price.

8. Limitation of Liability

  • Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

  • Subject to the above, Edge 360 Fitness shall not be liable for any indirect, consequential, or incidental losses, or for any injury or damages arising from your participation in our programmes.

  • Results will vary between individuals; no specific outcomes are guaranteed.

9. Privacy and Confidentiality

Edge 360 Fitness is committed to safeguarding the confidentiality of all personal information you provide in connection with the online fitness programme. We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 and are registered with the ICO under registration number…… You are encouraged to review our separate Privacy Policy, which sets out in detail how your personal information is collected, used, stored, and protected. By accessing or using our Services, you acknowledge and consent to the processing of your personal data as described in that policy. All personal data will be handled securely and will not be disclosed to any third party except where required by law or where we have obtained your explicit consent.

Your Commitment to Confidentiality
All programme materials provided by Edge 360 Fitness and The Parkinson’s Coach - including, but not limited to, videos, training modules, written content, exercise plans, and any other proprietary materials - are supplied strictly for your individual, personal use. You agree not to copy, share, distribute, reproduce, sublicense, upload, or otherwise make any such materials available to any third party without the prior written consent of Edge 360 Fitness Limited.

Breach of Confidentiality
Any unauthorised use, disclosure, or distribution of programme materials or confidential information shall constitute a breach of these Terms and Conditions. We reserve the right to suspend or terminate your access to the programme immediately in the event of such a breach and may pursue any legal or equitable remedies available to us.

10. Termination and Suspension

We may suspend or terminate your access to the Services at any time if you breach these Terms or if continued use poses a risk to our business or other users.

You may cancel your online subscription at any time by providing written notice to us. Cancellation will take effect immediately, and you will retain access to the programme and all associated materials until the end of your current billing cycle. Your subscription will not renew after that point.

No refunds, full or partial, will be issued for any unused portion of the billing period following your cancellation request.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will take effect upon publication on our website, with the updated date shown at the top. Continued use of the Services after any change means you accept the revised Terms.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising from them are governed by the laws of England and Wales. You and we agree that the courts of England and Wales will have exclusive jurisdiction in the event of a dispute.

13. User-Generated Content and Community Guidelines

  • Definition: “User-generated content” (“UGC”) means any content, including text, images, videos, comments, reviews, or other materials, that you or other users post, submit, or share through our Services.

  • Responsibility: You are solely responsible for any UGC you create or share. You must not post anything that is:

    • Illegal, offensive, abusive, defamatory, threatening, discriminatory, obscene, or harmful;

    • In violation of intellectual property rights or privacy rights of others;

    • Spam, promotional content, or commercial advertising without permission;

    • Encouraging or promoting unsafe practices.

  • Licence to Use: By submitting UGC, you grant Edge 360 Fitness a non-exclusive, royalty-free, worldwide, transferable licence to use, reproduce, modify, publish, distribute, and display your content for purposes of running and promoting the Services.

  • Monitoring and Removal: We may review, moderate, or remove any UGC at our discretion, without prior notice, if we believe it violates these Terms or is inappropriate.

  • No Liability: Edge 360 Fitness does not endorse, verify, or assume responsibility for UGC. We are not liable for any loss, damage, or dispute arising from content posted by users.

  • Community Interaction: You agree to interact respectfully with other users. Harassment, bullying, or abusive behaviour toward other participants will not be tolerated and may result in account suspension or termination.

14. Dispute Resolution

  • If any dispute arises out of or in connection with these Terms, including any question regarding their existence, validity, or termination, the parties should first attempt to resolve it amicably through good faith negotiations.

  • If the dispute cannot be resolved through negotiation within 30 days, either party may refer the matter to mediationusing a neutral mediator agreed upon by both parties. The mediation will take place in England and Wales and be conducted in English.

  • If the dispute is not resolved through mediation within 60 days of the initial referral, either party may bring proceedings in the courts of England and Wales.
